These Terms of Service (“Terms”) govern your access to and use of http://www.stimsixhealth.com (the “Site”) and the telehealth and wellness services (the “Services”) offered by StimSix Health & Vitality Clinic (“StimSix,” “we,” “us,” or “our”). By accessing the Site or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old and located in the United States to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Nature of the Services

StimSix connects you with U.S.-licensed healthcare providers who may evaluate you and, where clinically appropriate, prescribe treatment that is dispensed and shipped by licensed pharmacies. Use of the Services does not guarantee that you will receive a prescription or any particular treatment. Whether to provide treatment is solely within the professional judgment of the provider, and a provider may determine that the Services are not appropriate for you.

3. No emergency or in-person care

The Services provide telehealth consultations and are not a substitute for emergency care, in-person examination, or ongoing care with your primary physician. Always seek the advice of a qualified healthcare professional for questions about a medical condition.

4. Informational content is not medical advice

Content on the Site is provided for general informational purposes only and does not constitute medical advice, diagnosis, or treatment. A provider-patient relationship is formed only after you complete an evaluation and a provider agrees to treat you.

5. Prescriptions and pharmacy fulfillment

Any prescription is issued at the discretion of a licensed provider following an evaluation. Prescriptions are filled by licensed pharmacies, and shipment timing and availability may vary. You are responsible for using any medication only as directed and for reporting side effects or adverse events to your provider or to us at info@stimsixhealth.com.

6. Accounts and information

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it updated. Providing false health information may affect your safety and may result in denial or termination of Services.

7. Payment, billing, and cancellation

By purchasing a program, you authorize us and our payment processor to charge your payment method for the applicable fees. Where care requires provider approval, you will not be charged until a provider approves treatment. Subscription programs continue until cancelled in accordance with our cancellation and refund policy. Prices are subject to change with notice.

8. Shipping

Prescribed products are shipped by our partner pharmacies to the address you provide. You are responsible for providing an accurate shipping address and for compliance with any applicable laws regarding receipt of the products.

9. Acceptable use

You agree not to misuse the Site or Services, including by: providing false information; reselling or redistributing any medication; attempting to obtain medication without a valid evaluation; interfering with the Site’s operation or security; or using the Services for any unlawful purpose.

10. Intellectual property

The Site and its content, including the StimSix name, logo, text, graphics, and design, are owned by or licensed to StimSix and are protected by applicable intellectual property laws. You may not copy, reproduce, or use them without our prior written permission.

11. Third-party services

The Services rely on third parties, including our telehealth platform, licensed providers, pharmacies, and payment processors. Your use of those services may be subject to their own terms and privacy practices. We are not responsible for the acts or omissions of independent third parties except as required by law.

12. Disclaimers

The Site and Services are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. Individual results vary and are not guaranteed. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law, StimSix and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Site or Services. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for professional medical services rendered by licensed providers.

14. Indemnification

You agree to indemnify and hold harmless StimSix from any claims, losses, or expenses arising out of your misuse of the Services or violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute will be resolved in accordance with the dispute-resolution process described here, and you and StimSix agree to the exclusive jurisdiction and venue of the state and federal courts located in Utah, except where otherwise required by applicable law.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the most recent version, and your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
